Could I have a private post please ??

Anyone fancy mashing their brains ?? Please help me figure this one out …

I work on a 0 hour contract but am classed as a worker as if I say I will do a shift I have to find cover or there will be consequences such as loosing my job, when I’m there I have to stay for the whole shift and can’t leave etc

Everyone who works there on a contract have unions and have gone through their unions due to being paid under minimum wage because we work 25 hour shift , get paid for 16 of them £8ph then a sleep in where we get paid £30 for the entire sleep of 9 hours … during the sleeps if a alarm goes off which it does sometimes 5/6 times a night we have to get up and deal with whatever the issue is , on a sleep we can’t pop out somewhere we have to be there the entire time .

What the unions and Acas are saying is we should be paid at least minimum wage for the entire 25 hour shift we are there and I’m currently going through this with Acas trying to get my money back for all the shifts I’ve done once a week since May …. if I’m awarded this how will it effect my tax credits, housing benefit etc I’ve already received ?

Cause I’ve told them I work 16-18 hours a week on average but if I get this money back I’ve worked 25 hours a week ? Technically I do a 25 hour shift every week but get
£8ph from 8am-11pm
£30 from 11pm-8am
£8ph from 8am-9am (sometimes I wouldn’t have to stay for this hour which is why I’ve said between 16-18 hours per week)

Baisically I pay out £503 a month childcare
Get £203 per week tax credits INCLUDING the childcare element, child tax and working tax
£26 per week housing benefit towards £98 a week rent
£3 per week council tax reduction off £22 per week
On average I bring home £600-£700 a month wages but if I get this money back it’s going to change my earnings to be an extra £100 per month if they back date it to minimum wage or if they backdate it to my hourley rate £160 a month will I be expected to pay back all the help I’ve had ? How will it work with tax credits if I have told them I work 16-18 hours a week but indeed have worked 25hours a week

Or if I don’t get the money back how will it effect tax credits in April when I renew and they see I’ve been working 25 hours a week but been paid for 16-18 hours a week ? I’m so confussed and stressed by it all 😂

Second question is I worked my last shift for the company this weekend but due to the 0 hour contract I’ve worked thee since May and had no holidays , boss has admitted I’m entitled to holiday pay but not annual leave and that I should get all my holiday pay BASED on the 16-18 hours a week I’ve done since May at the end of this month but surely the holiday pay should be based on the 25 hours a week and if I’m being paid my holiday pay the end of this month does that mean I’m still in employment but technically on holidays until the end of the month or do I need to inform tax credits that I’ve left employment since this weekend … my hours on holiday pay should be around 51 hours of pay according to gov website ?
