My husband has 50/50 shared care of his daughter & took his ex to court to make this proper. However his ex still isn’t keeping to the court order & refuses to let him have his daughter at times & is late dropping her off or is never ready when we go to collect etc. My step daughter also 90% of the time comes to our house & tells me she wants to live with me & her dad. There are so many awful things that happen at her mums & she’s really not looked after properly & at one point my step daughter went to commit suicide at her mother’s as she was so unhappy. She came to live with us full time but we had to go back to shared care court order as police didn’t want to know! Social services know things but they also aren’t doing anything! Our solicitor has also said to us if we want to go to full custody it’ll be hard as we already have a court order in place?!

Basically my question is, has anyone else been in this situation & would it be easy for us to go to court for full custody? Or how would it go if we took her there for it sticking to our original court order? And also has anyone’s child told the courts what they want themselves & how old were they?
