Me and my girlfriend have been together for over 7 years, I have 3 children from a previous relationship but we have recently had a baby via a sperm doner (all done at home not a clinic) it was something we wanted for a while and it worked first time. We have never been more happier and our family is now complete. My question is is there any legal way she can have some sort of official mothership/guardianship over the child, as we are a same sexy couple there wasn’t a way we could both be on the birth certificate. I have thought about her adopting all 4 as her own, can we do this without being married? Can this be done at all? I’m really confused as I don’t want her to feel as if she has no rights…she’s been like a mother to my other children (even tho they don’t call her mum) and a fantastic mummy to our baby…help plz? X

    I want to thank you all for your advice it is much appreciated and I will get in touch with my solicitor as soon as possible and get things in place.

  • You can easily apply for step parental responsibility for all 4 children at ur local family court. You just need to get the form and have id. Congratulations on ur new baby. Me and my wife have been together 10yrs and having our 4th child (3rd donor baby)

  • Ive just gone threw the same thing, I wasn’t the birth mum so I spoke to a solicitor who said I can either adopt and speak to the local adoption authority who will start the process, or I can get my partner to sign a parental rights form, although using this option doesn’t guarantee custody if something was to happen to the birth mum. As it was a donor you won’t need fathers consent as the birth certificate should have been left blank where it should have a father. Solicitor said to adopt the estimated price is £1000 but can’t be 100% as court fees are added. Make an appointment with a solicitor you get 30 mins free advice x

  • Marriage or civil ceremony is the only way in which 2nd parent can now legally be on birth certificate, and I believe the rules for this have changed to having to be in place before conception. However you can apply to courts for parental rights (same rights as birth certificate) which apparently stand at a very high chance of being granted due to the circumstances especially if you have a doner contract in place. However not sure about your 3 children as haven’t been in that situation. Good luck x

  • Only through marriage as we had the same with last little one my now wife couldn’t go on it as we wasn’t married but this time round she should be able to as we are married now I think you can go through adoption route tho? X

  • As a same sex couple you have to be married before conception for your partner to be put on b.c you can go to the solicitor and discuss a parental responsibility order – ( ain’t 100% positive if you have to be married for it ) as I know other same sex couples doing it – the others kids prob could have parental responsibility aswell but all depends if there is a father on the b.c etc x

  • We have been through the same I had 3 kids before we met and we had a little boy together after we got married who is now 10 u can do it through a solicitor so she has same or some rights to the child u had together not sure about the other kids hope that helps x

  • She can adopt but to be legally on the birth certificate you habe to be married before time of conception x
