Could I have a private post please..
I popped into work today to sort maternity leave out, It starts on the 11th June 2017 so I haven’t claimed anything yet.. they have said I’d have to pay back 70% of my maternity pay as I’m not going back.. my question is if im not going back then why would they pay it to only take it away again? It’s alright saying ‘keep it aside and pay it back at the end’ but 70% will be a lot of money! What would I be entitled too otherwise? I have always been in full time employment and so is my boyfriend. Reason for not returning is id be working 5 days a week 12.5 hr shifts and my boyfriend works 5-6 days a week 13 hour shifts.. wouldn’t be fair on baby and I’d like a job with less hours. FTM and unsure of what I’m entitled to.. work are being very unhelpful.

    I tried telling them that and they are still saying I have to pay back 70% I don’t want employment maternity pay if I have to pay it back, be way to much money šŸ˜” just stressing over it all. I’m also on annual leave at the minute as haven’t been in great health during pregnancy and now they are saying I have to pay that back too šŸ˜” I’m only 7 days into it but can’t do anything til they sort it out x

  • Can I have a reply to my post again please.
    I don’t want to go back part time, it’s still 12.5 hour shifts, and they won’t allow me go part time either. Also if I want to claim full maternity then I have to go back to work for 6 months to not pay anything back, not 6 weeks. I’ve worked since I was 15, always paid my way, this baby was unexpected due to supposedly not being able to have children, I think I deserve time off to see her grow also. I can live on statutory maternity pay as my boyfriend works, but I can’t afford to have money given and then taken away. I’m happy with statutory and I told them that but they are still saying I have to pay back 70% šŸ˜” x

  • Hi hun. I’m a Payroll Manager. As others have said if you are in the UK, providing you have met the qualifying conditions i.e length of service / level of pay then you are entitled to 39 weeks SMP and all your normal holiday entitlement for the maternity period. Some Employers do offer an enhancement which they can ask you to repay if you don’t return to work, but you keep all your SMP. I would suggest you contact ACAS or the Maternity Alliance rather then CAB. Good Luck x

  • If its the company, go back and work your said given notice would be the only way out of it sadly. Be better than paying 70% of your pay. Your contract will give you the amount of notice you need to work obviously depending on how long you have worked for them x

  • You do not need to tell your employer until at least eight weeks before your maternity is due to end about whether you will be returning or not. You also need to check the company handbook about paying maternity pay back. Most companies you don’t have to pay it back if you choose not to return or you have to return for a month for it not to be paid back. You are also entilited to request to reduce your working hours prior to you returning. Your employer would have to give a very strong reason as to why they wouldn’t accept your reduced working hours.

  • You only have to pay anything back that the company gives you. Statutory maternity pay is paid through work but it’s from the government. It works out Ā£500 odd a month. So anything more will be from the company and should only be 70% of the amount going over

  • Are you getting statutory maternity pay(which is actually paid by the government) or a special package from your work? Because if it’s just statutory you don’t pay it back I’ve been through this twice xxx

  • You have the right to ask for reduced hours and flexible hours. If they can’t meet them then they have to let you go so there fore it wouldn’t mean that you owe them any money. I’m not 100% sure on the rules but try cab

  • Why don’t you ask to return based on a part time basis?! I don’t think they can refuse you going back part time and in that way there isn’t the issue of paying 70% back…altho i don’t know anything about that.

  • Like others have said if it’s statutory pay then no you don’t. However if it’s maternity pay through work you have too go back for 6 weeks then you won’t have too pay it back

  • Can i ask what type of work you are in?? I work in education and we get SMP and OMP (occupational) in my work you opt in for OMP if you are going back to work but if you know you arent you dont have to opt in. If you opted in and decide while on leave you dont want to go back then you have to pay OMP back. OMP is 70% of your pay. Hope this helps. Feel free to PM me hun x

  • Your company should be offering you different hours in order for you not to leave. Have you seen anyone in your HR department. If you don’t have a union then get in touch with ACASS they will give you impartial advice šŸ˜Š

  • I’d suggest you speak to the CAB about your rights – I have a feeling you can legally request to go back on reduced hours

  • If you are only receiving statutory maternity pay you don’t have to pay it back because the government pay it back to the company, you only have to pay money back if you are payed more than statutory xx

  • Speak to HR and see if you can reduce your hrs. That’s well over full time hrs so not sure why your working that x

  • Your partner can get paternity leave which could cover the time you need to go back for.
