Hey can I have a private post please… my friend is in court this week for ‘assaulting’ someone and criminal damages but in both statements and even the police said it was more of a ‘tit for tat’ but still he’s getting charged for the lowest common assault, anyway… the witness has said they can’t make it to court tomorrow so my friend phoned 101 up and they said the court is still meant to be happening tomorrow but his solicitor thinks it’s cancelled… my question is can they still carry on with the court case if the witness is not attending? Because to me it doesn’t make sense if the witness has been summonsed to court if they do not attend then the case just gets thrown out or moved to another date anyone have any experience with something like this as I’m very confused and obviously want it to be a fair trial with the witness and defendants say… thank you in advance and please no bashing don’t know the ins and outs of the law that well x

Usually if the main witness is a no show it gets thrown out but if they have notified the court the date will be changed you will just have to wait till tomorrow but he must attend unless otherwise informed by his solicitor or the court
Deffo attend it may get thrown out x
