Pp please, thanks.
I left my son’s dad in Aug 2008, he took me through court & admitted all DV so only got access at a contact centre which he himself turned down. I have a residency order. My son is now 11 & over the years we’ve had the odd pop up from his dad over Facebook saying he’s coming to take him. Police have always been informed (warned him to keep away & if he’s to do anything he would have to go back through court etc). My question is I’ve been with my partner now for 6 years & would love my son to have the same last name as our other children. He’s already ‘known as’ the last name but it’s not legal. Is there any way I make it legal? My son’s dad IS on his birth certificate. There has been no contact in 8 years. Thanks In Advance x

  • In Scotland if a father has had no contact for 5 years he forfeits his parental rights, my son has his step dads name and he has legal parental rights and responsibilities through a court xx

  • As dad is on the BC the ONLY way to change the name legally is with dads or a courts permission.
    More people will probs come along and say you can just do it by deed poll as they have done it etc etc, however. the onus is on you to ensure permissions on order not them, so unless the correct permissions are in place the change is not legal and you will have paid for a useless piece of paper.

  • You can do it through your solicitor, but he has to accept because he’s on the bc. If it’s in the child’s best interests or benefits the child to have his name changed then it’s automatically granted. Plus I’m sure because he’s 11 he can state his own reasons why to the solicitor so his opinion will be considered because of his age. Ive looked into this for my 2 year old, though I’m in Northern Ireland so might be different x
